What does it mean?
The United Nations Development Programme (UNDP) in Somalia has been supporting the government’s efforts in effective implementation of the National Development Plan (NDP), which is aligned with the corporate Sustainable Development Goals (SDGs). In support of development plans outlined in the NDP, UNDP in collaboration with a wide range of stakeholders including government, multilateral agencies, private sector and civil society has been developing and implementing projects in its main thematic areas of Economic Growth and Employment, Democratic Governance, Rule of Law and Security, Human Development and Economics, and HIV/AIDS. These projects contribute towards achieving the overall national goal of socioeconomic transformation for poverty reduction, economic revival and societal transfer in a socially just and gender equitable manner.
The Rule of Law (ROL) Portfolio includes projects and programmes on justice, police, and security Sector Reforms, Preventing and Countering Violent Extremism and Human Rights. These five projects and programmes are interlinked and address the overall Contributing Outcome under the UN Strategic Framework priority 2: “Supporting institutions to improve Peace, Security, Justice, the Rule of Law and safety of Somalis” and strategic priority 3: “Strengthening accountability and supporting institutions that protect”. It addresses the National Development Plan on RoL and Access to justice goal, to “establish independent, accountable and efficient justice institutions capable of addressing the justice needs of the people of Somalia.”
Under the auspices of an integrated UN Joint Justice Programme comprising UNDP, the United Nations Assistance Mission in Somalia (UNSOM), UNICEF, and UN Women, UNDP manages the programme and funds allocated to it while UNSOM’s Joint Justice and Corrections Section (JJCS) provides technical expertise, contributes to the development of the rule of law strategic plan and policymaking framework in the context of the mission’s mandate, guidance regarding the political and strategic dimension of justice reform, and ensures the integration of all outputs into the transition plan through the Comprehensive Approach to Security.
Within this context, UNDP requires services of a Judicial Expert to support UNSOM to enhance the alignment between the political and development mandates. The Judicial Expert will report to and receive overall guidance from the UNSOM JJCS Chief, and administratively will report to the UNDP Rule of Law Portfolio Manager.
DUTIES AND RESPONSIBILITIES
Summary of key functions:
Ensure the development and implementation of the Justice and Corrections Model for Somalia
Ensure Institution building within the Justice sector in Somalia
Ensure capacity building of court personnel
Ensure engagement with national and international counterparts
The Judicial Expert will undertake the following tasks:
Ensure the development and implementation of the Justice and Corrections Model for Somalia:
Provide technical support to the Federal Government of Somalia (FGS) and Federal Member States (FMS) on the federalization of the justice sector with the objective of obtaining a political agreement on the justice and corrections model;
Advise national counterparts on the management structure of the Justice and Corrections model;
Participate in the development of terms of reference for technical committees as part of the management structure;
Provide technical support to different technical committees;
Work with partners on the development of FGS justice plan and FMS state justice plans and their implementation.
Ensure Institution building within the Justice sector in Somalia
Participate in the drafting of by-laws/regulations regarding the functioning of the Judicial Service Commission and Constitutional Court;
Review legislation and draft commentaries and other relevant documents.
Ensure capacity building of court personnel
Provide technical guidance to justice Government Personnel on mentoring sessions with prosecutors and judges;
Conduct regular sessions with court personnel in Banadir region;
Evaluate the impact of mentoring sessions, identify challenges, best practices and lessons learned;
Prepare legal research and analysis on new developments in the justice sector, particularly regarding judicial independence, the appointment and dismissal of judges, high profile cases etc.
Provide one training on the preparation of the State justice plans and the Institutional and capacity development plans for the Ministries of Justice at the Federal Member States and Federal government institutions.
Ensure engagement with national and international counterparts:
Participate in the Joint UN Global Focal Points (GFP) for Rule of Law;
Participate in any relevant coordination meetings within the UN, with the Donor community and with national partners.

One technical workshop on the Justice and corrections model on the key outstanding issues
Concept note on management structure and ToR for technical committee model for management structure TORs developed
One training provided to the FMS and FGS justice and judiciary on the development of the state justice plans
All justice state plans reviewed
One training provided on the development of institution and capacity development plans
All institution and capacity development plans are reviewed
Organized workshop for development of regulations regarding the Judicial Service Commission (JSC) code of conduct or complaint mechanisms and Constitutional court
Two mentoring sessions with judges in Banadir courts conducted
Ability to make new and useful ideas work

REQUIRED SKILLS AND EXPERIENCE
An advanced university degree (Master’s degree or equivalent) in law, or bar qualification or equivalent, in addition to a first-level degree in law, is required.
A first-level university degree in combination with two additional years of relevant academic qualifications and/or legal experience in the field of justice and/or rule of law assistance may be accepted in lieu of the advanced university degree.
A minimum of seven years of progressive professional experience as a practicing lawyer, prosecutor, judge, legal academic, legal Judicial Expert, or adviser in the field of justice is required; this must include a minimum of one year of experience providing technical assistance for the development or reform of legal and judicial institutions in a transitional, developmental or post-conflict setting;
Work experience in a transitional, developmental or post-conflict setting/context is desirable and previous experience in Somalia is an asset;
Management experience is desirable. UN field experience, especially in a peacekeeping operation of special political mission, is desirable.

Easily adaptable to new cultural working environment and, ability to live and work in challenging physical environment.
