Purpose of the Assignment

The Ministry of Justice, Judiciary and Religious affairs of Jubbaland in partnership with United Nations Development Programme (UNDP) is promoting to expand legal aid services to the ADR centers and other remote areas in Jubbaland.

To this end the ministry of justice of Jubbaland, will hire three paralegals in Jubbaland who will deliver legal aid services to the vulnerable groups including IDPs, women and children.

The main work of paralegals is to provide primary Legal aid services to the vulnerable groups, and as well as carry out regular visits to the ADR centers, police station, or IDP camps to expand legal aid services in line with international and national legal framework of access to justice and human rights.

Key Responsibilities and Duties

  • Provide legal assistance, legal counseling, legal information to Somali citizens, particularly to women, minorities, and other vulnerable groups, on how to address their cases and access justice systems, both formal and informal;
  • Interview clients and Provide legal aid services, including advice and information on how to realize their rights;
  • provide information and guidance to the clients and communities the available legal services and options for obtaining remedies
  • Carry out regular visits to the ADR, IDP camps, Local district office, Court, police stations and prison to report cases, and provide/offer legal aid services, i.e. information, legal assistance and referrals;
  • Act intermediaries between traditional and formal legal system, link traditional elders and legal aid serves and refer legal cases from in formal to the formal justice system where appropriate.
  • Prepare legal documents as requested by the clients including legal petitions, or any legal documents required by the ADR House.
  • During mediations at the ADR houses, encourage sheikhs or traditional elders to apply and incorporate human rights values and international standards of justice.
  • Provide orientation to the parties at the ADR houses to understand their rights under the sharia and somali laws
  • Attend mediation sessions at the ADR centers or IDP camps, provide orientation to the arbitrators/mediators to apply human rights values and justice principles
  • Carry out regular visits to the IDP camps, ADR houses and District Administration office to report cases, and provide primary legal aid services i.e. information, legal assistance and referral
  • Provide support to the ADR clerks in the documentation of the cases and procedures of handling cases.
  • Identify and report cases out of the ADR jurisdiction or without respecting the Standard Operating Procedures of the ADR Centres
  • Support ADR clerks in the correct classification of the cases
  • Report the cases and refer to the lawyers for legal representation in the formal justice system;
  • Prepare legal documents as requested by the clients including legal petitions, or any legal documents required by court.
  • Support survivors and victims in domestic violence cases, by accompanying them to the police to lay a charge, to see a doctor and refer them to a lawyer for assistance.
  • act as a friend of an unrepresented accused during which time they may not represent the accused but may quietly provide him or her with advice and assistance during the trial.
  • Assist prisoners who are waiting trail to understand the law, how it affects them and how to apply it in their own case
  • ensure vulnerable groups (women and children, the elderly and terminally/mentally ill, foreign nationals) in the prison are given priority.
  • assist prisoners to fill in bail forms agreed with the judiciary which paralegals then lodge with the appropriate court.
  • Trace and screen remand prisoners, juveniles and women in the places of custody/prison and refer to available legal services needed.
  • Conduct follow up to ensure that clients are received and satisfied with the justice services.
  • Visit to the police station to provide client information on his/her rights and link with lawyers for legal representation
  • demystify and provide guidance to the accused and witnesses during pre-trail or trail, and orientate public to understand the court procedures.
  • alerting the courts when someone has been held beyond the legal limit on remand.
  • ensure bail forms from prison are submitted promptly to the registry and followed up
  • Assist in tracing of parents or guardian of young offenders who are in custody in the police station
  • interview young offenders and propose diversion over prosecution in the appropriate cases.
  • Link with lawyers and Resort some cases to the litigation in the courts if the alternative dispute resolution fails
  • sit with young persons in police interview and advise them of their rights under the Laws of somalia
  • Assist unaccompanied children during interview by the police in the police stations
  • Laisse and Link with police station, court and prison in following up cases.
  • Provide specific legal aid services on victims of GBV i.e. women and children in the IDP camps
  • Empower IDPs to understand legal system and navigate them to the available justice system for justice services.
  • Support existing dispute resolution committees at the IDP camps.
  • Refer the SGBV survivors the psychosocial, protection and health providers;
  • Laisse with the relevant government agencies, civil society organizations, CBOs, INGO, UN entities on the relevant issues pertaining to Justice, human rights and protection
  • Attend monthly legal aid coordination meetings in southwest
  • Prepare, develop, and disseminate information, education and communication (IEC) materials on access to Justice Referral pathways.
  • Prepare weekly reports on legal aid services provided.
  • Conduct follow up to ensure that clients are received and satisfied with the justice services.
  • Assist in conducting and preparing mapping of relevant legal aid services being provided and updating it on a weekly basis
  • Assist with using clear and strong referral mechanisms with counterparts in other organisations/agencies (national and international) in the legal aid service delivery.
  • Perform any other tasks requested by the ministry of justice, judiciary and religious affairs of Jubbaland State of Somalia.

Required Qualifications and experiences

  • Have a Degree or Diploma in law and sharia, political science, Human rights or any relevant studies.
  • A minimum of 1-year experience in law, protection or social work.
  • Have good knowledge about the national legal systems in Somalia including Jubbaland
  • Basic legal knowledge and understanding of formal and informal justice system in Somalia
  • Have good experience in case management
  • Preferable experience at the community level.

Desired skills and competencies

  • Sound knowledge of computer skills (MS word or excel)
  • Good understanding legal pluralisms in Somalia
  • Good communication skills
  • Good reporting and case management skills
  • Fluent in English and Somali both writing and speaking
  • Sound knowledge of formal and informal justice system
  • Strong experience in advocacy and Alternative dispute resolutions mechanism
  • Ability to engage and interact with community
